Terms and Conditions (T&Cs)
Article 1 – Definitions
In these Terms and Conditions, the following terms apply:

Right of Withdrawal: The consumer’s right to withdraw from a distance contract within a specified period.

Consumer: A natural person acting outside their trade, business, or profession when entering into a distance contract. The consumer benefits from statutory consumer protection.

Day: A period of 24 calendar hours.

Duration of Contract: A distance contract for the purchase or delivery of products and/or services over a specified period.

Durable Medium: A means that allows the consumer to store personal data so that it can be accessed unchanged later.

Entrepreneur: A natural or legal person who enters into distance contracts with consumers and offers goods and/or services.

Distance Contract: A contract concluded exclusively using distance communication means, without the parties being physically present at the same time.

Means of Distance Communication: Means that allow a contract to be concluded without the physical presence of the consumer and the entrepreneur.

Terms and Conditions: These general terms and conditions of the entrepreneur.
Article 2 – Scope
These T&Cs apply to all offers, concluded distance contracts, and orders between the entrepreneur and the consumer.
The consumer is asked to review the T&Cs before concluding a distance contract. If this is not possible, they must be informed that the T&Cs are available from the entrepreneur free of charge upon request.
If the T&Cs are provided electronically, they must be provided in a form that allows the consumer to store them on a durable medium.
Special conditions for specific goods or services apply in addition to these T&Cs. In case of conflict, the provision most favorable to the consumer prevails.
If a provision is invalid, the remaining provisions remain valid. The invalid provision is replaced with one that comes closest to the original purpose.
Article 3 – Offers
If an offer has a limited validity or is subject to conditions, this must be clearly indicated.
Offers are non-binding. The entrepreneur reserves the right to modify them.
Offers must contain a complete and accurate description of goods/services. Images must correspond to the actual product. Obvious errors are non-binding.
Prices exclude import duties and VAT, which are borne by the buyer.
Offers must include:

Validity period or price guarantee

Any costs of distance communication

Procedure to access the contract and archive it

Possibility to review and correct data before confirmation

Other available contract languages
-
Ethical standards of the entrepreneur

Available sizes, colors, materials

Separately stated shipping costs
Article 4 – Contract Conclusion
The contract is concluded once the consumer accepts the offer and meets the conditions.
If acceptance occurs electronically, the entrepreneur confirms this immediately. The consumer may refuse acceptance until confirmation occurs.
The entrepreneur must take technical and organizational measures to secure electronic transactions.
The entrepreneur may check the consumer’s creditworthiness.
The consumer receives:

Address for complaints

Procedure to exercise the right of withdrawal

Information on warranty and customer service
-
Other legally required information
The contract is concluded subject to product availability. If items are unavailable, the entrepreneur may contact the consumer up to three times; afterward, the next available variant (size/color) is shipped.
Article 5 – Right of Withdrawal
The consumer may withdraw from the contract within 30 days of receipt of goods without giving a reason.
During this period, careful handling of the product and packaging is required.
Withdrawal must be made in writing or by email within 30 days, and the goods must be returned within 30 days.
Article 6 – Costs of Withdrawal
In the event of withdrawal, the consumer bears the return shipping costs.
Refunds are issued within 14 days of receipt of the goods or proof of shipment.
Orders refused upon delivery without re-delivery are non-refundable.
Article 7 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Custom-made or personalized products

Personal items
-
Goods that cannot be returned for hygiene reasons

Perishable goods
-
Newspapers and magazines
-
Audio/video recordings or software once opened
-
Services (accommodation, transport, meals, leisure activities on a specific date)
-
Services performed with consumer consent before the withdrawal period ends

Bets and lotteries
Article 8 – Prices
Prices remain unchanged during the offer period unless VAT rates change.
Price changes due to financial market fluctuations are possible.
Price adjustments within three months after contract conclusion are only allowed within the law.
Delivery is from the shipping country. For shipments outside the EU, the buyer bears customs duties and VAT.
Article 9 – Performance and Warranty
The entrepreneur ensures that goods comply with the contract, offer, and legal requirements.
Warranty does not affect the consumer’s statutory rights.
Defects or incorrect deliveries must be reported in writing within 30 days and returned in the original packaging.
Warranty is void if the consumer made modifications or repairs, or if the defect arose from regulatory requirements.
Article 10 – Delivery and Execution
The entrepreneur processes orders carefully.
Orders must be delivered within 30 days; otherwise, the consumer may cancel within 14 days and request a refund.
If delivery is impossible, a replacement must be offered, with notice of the free return right.
The entrepreneur is liable for the product until delivered to the consumer.
Article 11 – Contract Duration: Termination and Renewal

Termination: Consumers can terminate indefinite contracts at any time with one month’s notice.

Fixed-term contracts: Termination possible after expiry with at least one month’s notice.

Renewal: Fixed-term contracts do not automatically renew, except for magazines (maximum 3 months).

Contracts over 1 year: Consumers may terminate anytime with one month’s notice.
Article 12 – Payments
Unless otherwise agreed, payment must be made within 7 days from the start of the withdrawal period per Article 6.1.
For service contracts, the payment period begins with contract confirmation.
Consumers must check payment data immediately and report errors.
In case of non-payment, the entrepreneur may charge reasonable costs according to law.
Article 13 – Complaints
Complaints about contract performance must be submitted in detail within 7 days of discovery.
The entrepreneur must respond within 14 days. If processing takes longer, the consumer will be informed of the expected duration.
If the complaint is justified, the entrepreneur will replace or repair the product free of charge.
In disputes, the matter will be submitted to the competent authority.
Article 14 – Disputes
This contract is exclusively governed by United States law, meaning interpretation, validity, and enforcement follow United Sates law, regardless of the consumer’s residence.
